Terms of Service

1. Acceptance of Terms
By accessing or using lemay.pub ("the Platform"), you agree to be bound by these Terms of Service. The Platform is operated by LeMay Publishing, a division of LeMay., organized under the laws of the Commonwealth of Massachusetts. If you do not agree to these terms, you may not use the Platform.
2. Services
LeMay Publishing provides manuscript submission, editorial enhancement, publication production (digital, audio, and physical formats), distribution, and sales services. The specific terms governing the publishing relationship between LeMay Publishing and its authors are set forth in the Publishing Agreement entered into upon acceptance of an Enhanced Edition.
3. User Accounts
You may create an account using Google authentication or email. You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate and complete information and to update such information as necessary. LeMay Publishing reserves the right to suspend or terminate accounts that violate these terms.
4. Manuscript Submissions
By submitting a manuscript, you represent and warrant that: (a) you are the author and sole owner of the work; (b) the work is original and does not infringe upon any existing copyright, trademark, or other intellectual property right; (c) you have full authority to submit the work and to enter into a publishing agreement; (d) no literary agent or third-party representative is involved in the submission; (e) the work has not been previously published in substantially similar form by another publisher.
5. Editorial Enhancement
LeMay Publishing performs editorial enhancement of accepted manuscripts at no charge to the author. The Enhanced Edition remains subject to author approval prior to publication. The editorial process is proprietary to LeMay Publishing. Authors may accept or decline the Enhanced Edition at their sole discretion.
6. Publishing Agreement
Upon acceptance of an Enhanced Edition, the author enters into a Publishing Agreement with LeMay Publishing. The standard terms include: a royalty rate of 50% of net revenue, a publishing term of five years, author retention of copyright, and a 90-day mutual termination clause. The complete terms are specified in the Publishing Agreement.
7. Royalties and Payments
Royalties are calculated monthly based on net revenue from all sales. Payments are processed within thirty days of the close of each calendar month via Stripe Connect. Authors are responsible for providing accurate payment information and for any applicable taxes on royalty income.
8. Purchases
All purchases are processed through Stripe. Prices are displayed in U.S. dollars. Digital purchases (ePub, audiobook) are delivered immediately upon payment confirmation. Physical orders are fulfilled through our production partner and are subject to shipping timelines. Refunds for digital products are available within 7 days of purchase if the content has not been substantially accessed.
9. Intellectual Property
Authors retain full copyright ownership of their submitted works at all times. LeMay Publishing retains ownership of its editorial enhancements, production materials, and proprietary systems. The LeMay Publishing name, logo, and associated branding are trademarks of LeMay.
10. Agent Prohibition
LeMay Publishing does not accept submissions from literary agents or other third-party representatives. Any submission found to involve agent representation may be rejected or, if already published, may be subject to contract termination.
11. Content Standards
LeMay Publishing reserves the right to decline any submission that constitutes: incitement to violence, targeted harassment of identifiable individuals, material that is illegal under the laws of the Commonwealth of Massachusetts, or content that LeMay Publishing determines, in its sole discretion, fails to meet minimum editorial standards for publication.
12. Limitation of Liability
LeMay Publishing provides the Platform and its services on an "as is" basis. To the maximum extent permitted by law, LeMay Publishing shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of the Platform or its services. LeMay Publishing's total liability shall not exceed the amount of royalties paid to the affected party in the twelve months preceding the claim.
13. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws provisions. Any disputes arising from these terms shall be resolved in the courts of the Commonwealth of Massachusetts.
14. Modifications
LeMay Publishing reserves the right to modify these Terms of Service at any time. Material changes will be communicated via email to registered users. Continued use of the Platform following such modifications constitutes acceptance of the updated terms.
